DMCA Policy

TechWave Designs ("we", "us", or "our") is committed to honoring the intellectual property rights of others and expects our users to do the same. In compliance with the Digital Millennium Copyright Act of 1998 (referred to as "DMCA"), we will act promptly to address claims of copyright infringement that arise through our services when reported to our designated Copyright Agent, as detailed in the example notice below.

If you are a copyright holder, or are authorized to act on behalf of one, or are permitted under any exclusive rights associated with copyright, you can submit a report of alleged copyright infringements occurring on or via our website (the "Site") by using the DMCA Notice of Alleged Infringement form and directing it to our designated Copyright Agent. Once we receive a valid Notice as outlined below, we will take appropriate action, at our sole discretion, which may include removing the infringing content from the Site.

• 1. Specify the copyrighted work you believe has been infringed, or if multiple works are involved, provide a representative list of them.
• 2. Indicate the material or link you believe is infringing (or associated with infringing activity) and the access to which should be disabled, including at a minimum, the URL from the Site or the precise location of the material in question.
• 3. Provide your affiliation (if applicable), mailing address, phone number, and, if possible, your email address.
• 4. Include both the following statements in the body of your Notice:
• * "I declare that I have a genuine belief that the disputed use of the copyrighted material is not approved by the copyright owner, their agent, or the law (e.g., as a fair use)."
• * "I affirm that the information contained in this Notice is correct and, under penalty of perjury, that I am the copyright owner or am authorized to act on behalf of the copyright owner concerning the exclusive rights being infringed."
• 5. Sign your full legal name and include your electronic or physical signature.

Be aware that under Section 512(f) of the DMCA, any individual who knowingly misrepresents that material or activity is infringing may face legal consequences.

If you believe that your content has been removed (or access has been restricted) in error and that you have permission from the copyright owner, the owner's agent, or under the law to use this content, you can submit a counter-notice to our Designated Copyright Agent, which should include the following:

• 1. Your electronic or physical signature;
• 2. Identification of the content that was taken down or access to which was denied and its location prior to removal or access restriction;
• 3. A declaration that you genuinely believe the content was removed or disabled due to an error or misidentification; and
• 4. Your name, address, phone number, email, a statement consenting to the jurisdiction of the federal court in Seychelles, and confirmation that you will accept service of process from the person who notified you of the alleged infringement.

If we receive a counter-notice, we may forward it to the original complainant, informing them that we might restore access to the removed material or cease disabling it within 10 business days. Unless the copyright owner pursues a court order against the content provider or user, the restored content may be made accessible again at our discretion within 10 to 14 business days after the counter-notice is received.

In line with the DMCA and other relevant laws, we have established a policy whereby we may terminate the accounts of users identified as repeat infringers at our discretion and may also limit access to the Site for anyone infringing the intellectual property rights of others, regardless of repeat infringement.
